RunPrivate provides tools for recording running activity and helping users monitor a chosen target pace.
2. App-store licence terms
If you obtain RunPrivate through an app store, your right to install and use the app is also subject to the applicable app-store licence terms. Where mandatory platform terms apply, these Terms supplement rather than replace them.
3. Not medical or professional advice
RunPrivate is a recreational fitness application. It is not a medical device and does not provide medical advice, diagnosis, treatment or professional coaching.
Information displayed or generated by RunPrivate, including pace, distance, location, calories, heart rate and other workout information, must not be relied upon for medical or safety-critical decisions.
If you have concerns about whether running or other exercise is appropriate for you, seek suitably qualified medical advice.
4. Exercise and safety
Running and physical exercise involve inherent risks. You are responsible for deciding whether, where and how to exercise safely.
You must remain aware of traffic, terrain, weather, other people and other hazards. Do not interact with the app in circumstances where doing so would be unsafe or distracting.
Pace alerts and haptic feedback are convenience features only. They do not override your judgement about an appropriate or safe pace.
5. Accuracy
RunPrivate relies on device hardware, sensors, GPS and operating-system services. These systems are not perfectly accurate.
We do not guarantee the accuracy, completeness or availability of pace, distance, route, location, steps, calories, heart rate, timing or other fitness measurements. GPS reception, sensor quality, battery state, environment, software updates and circumstances outside our control can affect results.
6. Apple Health, Health Connect and third-party platform services
RunPrivate may interact with operating-system services such as Apple Health/HealthKit, Location Services and, if released on Android/Wear OS, Health Connect and related platform services.
Those services are controlled by their respective platform providers and may be subject to separate terms and privacy practices. We are not responsible for outages, changes or inaccuracies in third-party services outside our reasonable control.
7. Availability and updates
We aim to keep RunPrivate functioning reliably but do not promise that it will always be available, uninterrupted or error-free.
We may release updates to fix bugs, maintain compatibility, improve security or change functionality. We are not obliged to add any particular feature or maintain compatibility indefinitely with every device or operating-system version.
8. Your responsibilities
You agree to use RunPrivate lawfully and responsibly. You must not:
- interfere with or disrupt RunPrivate or related systems;
- circumvent technical or security restrictions;
- reverse engineer the app except where applicable law expressly permits it;
- use RunPrivate for an unlawful purpose; or
- infringe intellectual-property or other legal rights.
9. Intellectual property
RunPrivate’s software, branding, design, graphics and original content are owned by the operator of RunPrivate or its licensors and are protected by applicable intellectual-property laws.
You receive a personal, limited, non-exclusive and non-transferable right to use RunPrivate for its intended purpose. No ownership rights are transferred to you.
10. Privacy
Our handling of personal information is described in the RunPrivate Privacy Policy.
RunPrivate is designed not to require an account or a RunPrivate-operated cloud service that receives your running, GPS or health history.
11. Limitation of liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful. In particular, nothing excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any mandatory consumer right that cannot lawfully be excluded or limited.
Subject to the paragraph above and to the fullest extent permitted by law, RunPrivate is provided as a recreational fitness aid and not as a safety-critical, medical or professional service. You remain responsible for decisions concerning your exercise, route, pace and personal safety.
To the fullest extent permitted by law, we are not responsible for losses that were not reasonably foreseeable when you started using RunPrivate, losses caused by circumstances outside our reasonable control, or indirect business losses where you use the app for purposes connected with a trade, business or profession.
We do not accept responsibility for loss or corruption of workout information caused by device failure, operating-system behaviour, third-party health platforms, permission changes or other systems outside our reasonable control.
Nothing in this section affects mandatory rights you have under applicable consumer law.
12. Discontinuation
You may stop using RunPrivate at any time by deleting the app. We may suspend or discontinue RunPrivate, or parts of it, where reasonably necessary, including for security, legal, technical or commercial reasons.
13. Changes to these terms
We may update these Terms when the app, applicable law or regulatory requirements change. The latest version will be published on this website. Where required by law, we will provide appropriate notice of material changes.
14. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales.
If you are a consumer, you retain any mandatory legal rights concerning the courts in which proceedings may be brought. Subject to those rights, the courts of England and Wales have jurisdiction over disputes arising from RunPrivate and, where legally permitted, proceedings should be brought in the courts sitting in London.
